State regulation in the field of seed production is carried out through:

1) certification of subjects of seed production, including:

primary certification of seed production entities;

recertification of the subjects of seed production after the expiration of the certificate of attestation:

producers of original seeds - once every five years;

elite seed farms - once every three years;

seed farms - once every three years;

seed distributors - once every two years;

annual post-certification examination of seed production entities for compliance with qualification requirements;

1-1) accounting of approbators and seed experts engaged in the testing of varietal crops of agricultural plants and the examination of varietal and sowing qualities of seeds;

2) maintaining the State Register of breeding achievements recommended for use in the Republic of Kazakhstan and the list of promising varieties of agricultural plants;

3) mandatory examination of seeds for varietal and sowing qualities;

4) conducting state control in the field of seed production;

5) permissive control;

6) conducting scientific research of a fundamental and applied nature in the field of seed production and breeding for the conservation, development and use of the gene pool of agricultural plants in accordance with the legislation of the Republic of Kazakhstan;

7) subsidizing the production, sale and purchase of original and elite seeds of varieties recommended for use in the Republic of Kazakhstan;

8) state support for variety testing of agricultural plants, expertise of varietal and sowing qualities of seeds, including seeds intended for sowing by Kazakhstani agricultural producers;

9) excluded by the Law of the Republic of Kazakhstan dated 04.12.2015 No. 435-V (effective from 01.01.2016);

10) formation of investment and credit policy in the field of seed production;

11) legal protection of the interests of seed production entities in the implementation of international cooperation in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

12) excluded by the Law of the Republic of Kazakhstan dated 07/10/2012 No. 36-V (effective after ten calendar days after its first official publication);

13) (excluded);

14) ensuring safety in the field of technical regulation (hereinafter referred to as safety);

15) prevention of actions misleading consumers about safety in the field of seed production.

The Law of the Republic of Kazakhstan dated February 8, 2003 No. 385.

This Law defines the legal, economic and organizational bases for carrying out activities in the field of seed production and is aimed at regulating the organization and functioning of the seed production system and state control over the production, harvesting, processing, storage, transportation, sale and use of seeds of agricultural plants.
